SGS Summarizes US Legislative Developments on PFAS in Consumer Goods
SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 030.24 to provide stakeholders with an overview of legislative developments in the US relating to the use of per- and polyfluoroalkyl substances (PFAS) in consumer goods.
PFAS, which includes perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS), are a diverse group of synthetic chemicals used in industry and consumer goods for their water, grease, oil and/or dirt repelling properties. Consumer goods containing PFAS include:
- Food packaging
- Ski wax
- Dental floss
- Firefighting foams
- Cosmetics
- Carpets and rugs
- Artificial turf
- Upholstered furniture
- Menstruation products
Due to their toxic effects and negative impact on the environment, PFAS are now being legislated against in multiple territories around the world. In the US, a number of jurisdictions have implemented regulations to restrict the use of PFAS, including California, Colorado, Connecticut, Hawaii, Maine, Maryland, Minnesota, New York, Oregon, San Francisco, Santa Rosa, Rhode Island, Vermont and Washington.
Since the start of 2024, several new bills have been introduced at the US state level to prohibit or otherwise regulate PFAS in specific products. These include Colorado, Hawaii, Illinois, Kentucky, Massachusetts, New Hampshire, New Jersey, New York, Rhode Island and Vermont. The language in these bills may change they progress through the legislature.
It is important to recognize that each jurisdiction will have its own scope and set of restrictions.
