New EU Documents for Assessing the Safety of Attached Components to Childrens Clothing Released

Suppliers of children’s clothing with small, attached components to markets in the European Union (EU) are advised that the European Committee for Standardization (CEN) has developed four new documents that should be referred to when ensuring compliance with the General Product Safety Directive (GPSD).

The four documents – one EU standard and three Technical Specifications (TS) – are based upon CEN/TR 16792:2014 – Safety of children’s clothing – Recommendations for the design and manufacture of children’s clothing – Mechanical safety.

They are:

  1. EN 17394-2:2020 – Textiles and Textile Products – Part 2: Safety of Children’s Clothing - Security of Attachment of Buttons – Test Method
  2. CEN/TS 17394-3:2021 – Textiles and Textile Products – Part 3: Safety of Children’s Clothing – Security of Attachment of Metal Mechanically Applied Press Fasteners – Test Method
  3. CEN/TS 17394-4:2021 – Textiles and Textile Products – Part 4: Safety of Children’s Clothing – Security of Attachment of Components Except Buttons and Metal Mechanically Applied Press Fasteners – Test Method
  4. CEN/TS 17394-1:2021 – Textiles and Textile Products – Part 1:  Safety of Children’s Clothing – Security of Attachment of Attached Components to Infants’ Clothing – Specification

EN 17394-2:2020 defines the test method for the security of attachment for functional and decorative buttons on a wide variety of children’s clothing. It covers only sewn-on buttons, toggle buttons and tack buttons.

Components not under the scope of EN 17394-2:2020 must be considered using either:

  • CEN/TS 17394-3:2021 – which defines the test method for assessing the security of attachment of functional and decorative metal mechanically applied press fasteners on a wide variety of children’s clothing. It cannot be used to assess eyelets and rivets
  • CEN/TS 17394-4:2021 – involving an extremely aggressive wash method, this can be used to assess all other components including labels, badges, sequins, rhinestones, rivets, eyelets and non-metal press fasteners. These are too small to be gripped in test equipment jaws or their integrity may be disrupted by gripping

Performance recommendations are provided in CEN/TS 17394-1:2021. This provides the requirements for the security of attachment for children’s clothing components that are considered as small parts, such as buttons, press fasteners, rivets, sequins, diamantes (or pieces of these components) which fit entirely within the small parts cylinder without compression.

 

It should be noted that these documents do not apply to childcare articles, footwear, toys, other articles sold with clothing. Disguise clothing, such as carnival clothing, falls under the EU Toy Safety Directive.

Andean Community Delays Enforcement of New Labeling Regulations for Footwear and Leather Goods

The General Secretariat of the Andean Community, a customs union comprising Bolivia, Colombia, Ecuador and Peru, has announced a delay to the enforcement of Resolution No. 2107 “Andean Technical Regulation for the Labelling of Footwear, Leather Goods, Travel and Similar Items.”

Originally passed in November 2019, it was planned that the technical regulation would be enforced twelve months after it was published in the Official Gazette of the Cartagena Agreement. The COVID-19 pandemic has, however, made it necessary to amend this date and, following Andean Community Decision 827, the new enforcement date is now November 15, 2021.

Andean Technical Regulation No. 2107 covers the requirements concerning the presentation of labelling information for:

  • Footwear
  • Leather goods
  • Travel items and similar goods

It also covers safety conditions and has the objective of prevent misleading practices.

Labels must contain, as a minimum, the following information:

  • Predominant materials that make up the product
  • Manufacturer or Importer identification
  • Size (footwear only) 
  • Country of origin or manufacture

This information may be presented on one or more label, which must be indelible, legible, visible and easily accessible to the consumer. The information must be presented in Spanish, although additional languages, expressions, abbreviations, symbols or pictograms may be used.

New York State Prohibits PFAS Substances in Plant Fiber Based Food Packaging

New York State has signed into law a prohibition on adding perfluoroalkyl and polyfluoroalkyl substances (PFAS substances) to some food packaging materials and articles.

The governor signed into law S8817 (companion A4739-C) on December 2, 2020. It amends the state’s Environmental Conservation Law and adds new § 37-0209 to prohibit PFAS substances in food packaging. The scope of the law covers food packaging made, predominantly, from paper, paperboard or other materials derived from plant fibers.

Definitions within the law include:

  • ‘Food Packaging’ – package or packaging component that is intended for direct food contact and is mainly comprised of paper, paperboard, or other materials originally derived from plant fibers
  • ‘PFAS substances’ – means ‘perfluoroalkyl and polyfluoroalkyl substances’, a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom
  • ‘Intentionally added’ chemical – means a chemical in a product that serves an intended function in the product component

PFAS substances are added to a wide variety of products to provide anti-stain, water, grease, oil and/or dirt repelling properties. In the context of food contact materials, they are known to be included in products such as fast-food containers, microwave popcorn bags, non-stick cookware, and paper wrappers for sandwiches and butter.

The new law will come into effect on December 31, 2022.
