Under the Gas and Electricity (Consumer Safety) Act 2017 in New South Wales, e-bikes, e-scooters, e-skateboards, self-balancing scooters and the lithium-ion batteries used to power these devices were ‘declared articles’. Published by the country’s Ministry of Agriculture, Forestry and Water Management, Rulebook OMG No. 98/2024 transposes EU Directive 2007/42/EC.

This legislation follows on from the national regulation OMG No. 80/2016, issued in 2016, which defined food contact materials and articles subject to specific measures, ensuring safety, traceability, good manufacturing practices (GMP), active/intelligent features, declaration of conformity (DoC), civil penalties, and the 'food contact safe' wine glass and fork symbol. This, in turn, is aligned with Regulation (EC) No. 1935/2004, the EU’s framework legislation for food contact materials and articles.

SGS Highlights the Addition of One Substance to the EU Candidate List

 

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 162.24 looking at the addition of triphenyl phosphate (TPP) to the European Chemicals Agency’s (ECHA) Candidate List of substances of very high concern (SVHC).

 

TTP is used as a flame retardant and plasticizer. With its inclusion on the Candidate List, use of this chemical on its own, or in mixtures or articles, is now subject to certain restrictions and obligations under EU law.

 

Suppliers of articles containing a Candidate List SHVC in the EU or European Economic Area (EEA) must fulfill several requirements concerning their duty to communicate the use of TTP, as well as notifying the ECHA under the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) regulation and the EU’s Waste Framework Directive. There is also a requirement for up-to-date safety data sheets for substances on their own and in mixtures.

 

Announced on November 7, 2024, the addition of TTP expands the ECHA’s Candidate List from 241 to 242 entries.
