SGS summarizes cancellation of French penalties for using the wrong recycling signs and markings

 

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 128.23 to help stakeholders understand France’s latest developments affecting signs and markings for sorting products into waste and recycling.

 

On July 6, 2023, the Supreme Administrative Court, Conseil d’États, of France published its decision relating to the execution of Decree of December 25, 2020, which covered the graphic elements for products in relation to recycling. An image containing two or more arrows rolled up and inscribed in a circle was proposed that unequivocally targeted the ‘green dot’. The decision was required following a request by several French federations in February 2021 to suspend it while its legality was considered. Their decision meant Order of November 2020 was officially cancelled.

 

The green dot is widely recognized in Europe, although it is prohibited in Spain and not recommended to use in other European countries

SGS publishes summary of Ukraines proposed order on food contact plastics

 

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 132.23 to provide an overview of Ukraine’s proposed order on food contact plastics.

 

Draft order ‘On Approval of Special Requirements for Plastic Materials and Articles Intended to Come into Contact with food’ was announced by the Ukrainian Ministry of Health on October 2, 2023. If accepted, it will approve a set of ‘special requirements’ for food contact plastics by implementing the consolidated version of the European Union’s Regulation (EU) 10/2011.

 

SGS has published SafeGuardS 132.23 to help stakeholders stay informed about proposed requirements affecting the manufacture, sale and distribution of food contact plastics in Ukraine. It contains a list of provisions in the draft order and a table containing the specific migration limits for a wide variety of substances, including aluminum, chromium, gadolinium, mercury and zinc.

 

Stakeholders are advised to review original SafeGuardS 132.23 to learn more about the proposals and how they will affect their business.

 

If approved, this order will be applicable from November 19, 2025, which is the same day as the Law of Ukraine of November 3, 2022, No. 2718-IX ‘On materials and articles intended to come into contact with food’.

SGS details Turkish draft amendment to revise its food contact plastic rules

 

SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS detailing Turkey’s intention to revise its Food Codex Communiqué on food contact plastics.

 

The revised draft amendment implements two amendments to the European Union’s Regulation (EU) 10/2011 on food contact plastics. These are:
- Regulation (EU) 2020/1245 (amendment 15 to Regulation (EU) 10/2011) – changes include provisions relating to 1,3-phenylenediamine, (FCM no 236), antimony trioxide (FCM no 398), several authorized substances, primary aromatic amines (PAA), a table defining the specific migration limit (SML) of 19 substances and an additional five substances where their migrations are subject to certain conditions and requirements for repeated use articles
- Regulation (EU) 2023/1442 (amendment 16) – an important revision which, among other things, delists two substances, adds and replaces several authorized substances and provides new specifications for several phthalates

 

Turkey’s revised draft amendment was circulated by the World Trade Organization (WTO) on September 4, 2023, attached to WTO document number 23-5884 and notified under G/TBT/N/TUR/135/Add.1

 

Stakeholders should be aware the revised draft amendment contains two important dates:
- Date of entry into force = date of publication
- Date of applicability = January 1, 2026

 

Food contact plastics placed onto the market before January 1, 2026, but which do not comply with the amendment, can remain on the market until January 1, 2028.
