New EU Legislation on BPA and Other Bisphenols in Certain Food Contact Materials

 

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 005.25, highlighting the EU’s comprehensive piece of legislation on the use of bisphenol A (BPA) and other bisphenols and bisphenol derivatives in certain food contact materials (FCM) and articles.

 

BPA is found in food and beverage containers, such as water bottles, and other consumer goods, and has been in use since the 1950s. Seepage into containers has been associated with health concerns around brain and prostate gland health in children, as well as behavioral issues, high blood pressure, type 2 diabetes and cardiovascular disease.

 

Commission Regulation (EU) 2024/3190 (the Regulation) on the use of BPA (listed as Chemical Abstract Service (CAS) No. 80-05-07)) and associated bisphenols and bisphenol derivatives was issued on December 31, 2024, harmonizing the classification for specific hazardous properties in certain FCM and articles.

 

The use of BPA in food contact plastics is also addressed in Regulation (EU) 2024/3190, which revises Regulation (EU) No. 10/2011. In addition, the new Regulation repeals Regulation (EU) 2018/213 on the use of BPA in varnishes and coatings.

CEN Publishes New Technical Specification for Passive Transportation Function Tricycles

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 010.25, highlighting the European Committee for Standardization’s (CEN) new technical specification covering the safety of tricycles that provide a passive transportation function.


The Toys Safety Directive 2009/48/EC established minimum safety standards for toys, including tricycles. However, the new technical specification (TS) – TS17876, published in October 2024, recognizes that some tricycles also provide a passive method of transportation, similar to a pushchair, via a bar or handle used by the adult, and in which the child is seated and restrained. This additional function was considered by the European standardization committee TC252, leading to the new TS.

In determining whether a tricycle falls under the scope of TS17876, several parameters, including marketing information, are considered. Where a tricycle is clearly sold as a pushchair, it must comply with all the relevant requirements of EN 1888-1. The new technical specification, TS17876, covers tricycles that are not marketed as pushchairs, but still provide a pushchair function by means of specific features.

US CPSC Publishes Final Rule for Implementation of eFiling of Certificates of Compliance Approved

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 189.24, highlighting the US Consumer Product Safety Commission’s (CPSC) approval of its final rule on the implementation of electronic filing (eFiling) of certificates of compliance (CoC) for regulated consumer products.

 

The new rule was published in the Federal Register on Jan 8, 2025. It will come into force 18 months from the date of publication, giving an effective date of July 8, 2026, unless the regulated products enter from a Foreign Trade Zone (FTZ) for consumption or warehousing, in which case their effective date is January 8, 2027.  

 

Mandatory eFiling will significantly impact the way products enter the US market. It will apply to all consumer products subject to mandatory safety standards and requiring certification, including de minimis shipments.

 

The CPSC will invite up to 2,000 additional importers to sign up for voluntary eFiling while the new system is tested and before it becomes mandatory.
